Terms and conditions

Kids aged 5-12

These Terms and Conditions outline the agreement between MAGNE ANIMATION and the parents or legal guardians of children participating in fitness classes. By enrolling the Child in the fitness classes, the Client agrees to these Terms and Conditions.

BOOKINGS:

(a) All bookings are accepted on a first-come, first-served basis until maximum availability.

(b) Bookings require full payment to be successfully processed.

LENGTH OF SESSION:

(c) The Session runs over six weeks, allowing the Instructor to establish a strong relationship with the child and work efficiently to achieve the predicted improvements. 

LENGTH OF CLASS:

(d) Every face-to-face class lasts 60 minutes.

(e) Every virtual class will last 45 minutes.

LOCATION:

(f)   The classes occur at THE HEART OF NEWHAVEN, Edinburgh, EH6 4HY.

(g)  Classes could also take place in the park with reasonable notice given to parents to promote outdoor activities and:

  • Overcome fears
  • Fight the obesity
  • Reduced stress levels
  • Improves moods and concentration
  • Develop a lifelong connection with nature
  • Enhances health and mental performances
  • Reduce the incidence of behavioural problems
  • Enhanced opportunities to improve social skills

(h) In case of unexpected government closures, the classes will occur virtually through the proprietary video teleconferencing software program Zoom. Parents/guardians will receive further instructions on how to set up the class for their child prior to the class. All that is required is a laptop or tablet.

CHILD REWARD SCHEME:

(i) The Instructor will release a Certificate at the end of each Block Term to recognise the child's progress.

(j) Some lessons incorporate the provision of unharmful prizes to increase child's motivation and acknowledgement of their efforts.

(k) In case of misbehaviour, the Instructor will not provide the child with the expected prize, adopting the Loss of Privilege technique to encourage children to take responsibility for their behaviour and promote good behaviour.

ABSENCE:

(l) To support class organisation, the Instructor requests that parents/guardians notify her of any anticipated absences prior to the session.

(m) The Instructor notifies parents/guardians that there will be no reimbursement in the event of a child's absence.

REFUND AND CANCELLATION:

(n) If your child cannot attend the registered Block Term due to personal circumstances, please contact the Instructor directly for further information.

(o) A full refund will be processed if cancellation is requested a minimum of two weeks before the previously booked Block Term begins.

INSTRUCTOR PROMISE:

(p) The primary purpose of each class will be to promote healthy habits (Physical Literacy) and physical activity.

(q) Children will be instructed in Exercise and Fitness according to their strength, mobility, flexibility, and capacity level.

(r) The classes will promote learning and knowledge by implementing educational games appropriate for every child's age range.

(s) Children will gain knowledge in Fitness, Anatomy, Nutrition, Geography, Music and Foreign Languages.

(t) Children will improve MEMORY, RHYTHM, COORDINATION, BALANCE, RANGE OF MOVEMENT and FLEXIBILITY via specifically designed dance choreography.

(u) Every child will be treated equally and with maximum respect, ensuring complete protection from discrimination.

Risk and Injury

1. Assumption of Risk

  • 2.1 Acknowledgement of Risk: The Parent/Guardian acknowledges that participation in fitness activities involves inherent risks, including but not limited to, physical exertion, contact with other participants, use of equipment, and potential for falls or injuries. The Client understands and accepts that these risks may result in physical injury to the Child.
  • 2.2 Voluntary Participation: The Parent/Guardian confirms that the Child's participation in fitness classes is voluntary and that the have discussed with the Child.

2. Health and Medical Conditions

  • 3.1 Medical Clearance: The Parent/Guardian confirms that the Child is in good health and physically capable of participating in fitness activities. The Client agrees to inform the Instructor of any pre-existing medical conditions, allergies, or any other relevant health information before the Child participates in the first class.
  • 3.2 Ongoing Health Monitoring: The Parent/Guardian agrees to notify the Instructor of any changes in the Child's health that may affect their ability to participate in fitness activities safely.
  • 3.3 Emergency Treatment: In the event of an emergency, the Parent/Guardian authorizes the Instructor to obtain medical treatment for the Child. The Client agrees to bear any costs associated with such emergency treatment.

4. Liability Waiver

  • 4.1 Release of Liability: The Parent/Guardian agrees to release, waive, and discharge the Instructor, their employees and representatives from any and all claims, liabilities, demands, or causes of action related to injury, illness, or damages incurred by the Child during participation in the fitness classes, except where such injury is directly caused by the gross negligence or wilful misconduct of the Instructor.
  • 4.2 Indemnification: The Parent/Guardian agrees to indemnify and hold harmless the Instructor from any claims or demands, including legal fees, made by any third party due to or arising out of the Child's participation in fitness classes.

5. Safety and Conduct

  • 5.1 Safety Guidelines: The Instructor will take reasonable steps to ensure a safe environment for fitness activities. The Child is expected to follow all safety guidelines and instructions provided by the Instructor.
  • 5.2 Risk Assessment: The Instructor will efficiently conduct a Risk Assessment prior Term that will enable to tailor the class to the children's abilities, prevent injuries, and create a safe and supportive environment. 
  • 5.3 Behavioural Expectations: The Parent/Guardian agrees that the Child will conduct themselves in a manner that ensures the safety and well-being of themselves and others. Disruptive or unsafe behaviour may result in the Child being removed from the class, with no refund provided.

6. Equipment Use

  • 6.1 Proper Use: The Instructor will provide guidance on the correct use of any fitness equipment.
  • 6.2 Responsibility for Personal Items: The Parent/Guardian agrees that the Instructor is not responsible for any lost, stolen, or damaged personal items that the Child brings to the class.

7. Reporting of Injuries

  • 7.1 Immediate Reporting: The Parent/Guardian agrees to report any injuries sustained by the Child during the class to the Instructor immediately.
  • 7.2. Accident Form: The Instructor agrees to notify Parent/Guardian of any occurred accident either upon pick up or immediately according to the severity of the accident.
  • 7.2 Follow-up: The Parent/Guardian agrees to provide the Instructor with updates on the Child's condition following any injury and to seek appropriate medical care if necessary.

8. Amendments and Updates

  • 8.1 Policy Changes: The Instructor reserves the right to amend these Terms and Conditions at any time. The Parent/Guardian will be notified of any significant changes in writing, and continued participation in classes will constitute acceptance of the revised terms.

9. Governing Law

  • 9.1 Jurisdiction: These Terms and Conditions shall be governed by and construed in accordance with the laws of Scotland. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the Scottish courts.

10. Agreement

  • 10.1 Acceptance: By registering the Child, the Parent/Guardian acknowledges that they have read, understood, and agree to these Terms and Conditions and that they have discussed the risks and responsibilities with the Child.
